The Sindh High Court (SHC) directed the authorities that married female government employees must be posted at the same location as their husbands under the government’s wedlock policy.
The decision came after a female teacher challenged the withdrawal of her transfer to Hyderabad. The petitioner was serving in Naushera Feroz while her husband worked in Hyderabad.
She argued that canceling her transfer violated the wedlock policy. Initially posted to Hyderabad, her transfer was later revoked by the Sindh Education Department.
A division bench led by Justice Mohammad Saleem Jessar observed that Article 35 of the Constitution obligates the state to protect family life. The court declared that separating a married woman from her spouse without valid reason amounts to punishment without cause.

The bench also clarified that the 2021 recruitment policy notification had no legal link to transfer under the wedlock framework. It ruled that the petitioner’s transfer had been unlawfully canceled under a “blanket cover” without due consideration.
Allowing the petition, the SHC reinstated the petitioner’s Hyderabad posting and ordered her biometric ID restoration.
The court stressed that executive authorities must prioritize family unity when handling postings. Separation causes both psychological and financial difficulties.
