Indus Waters Treaty Arbitration decision favors Pakistan’s position

The Indus Waters Treaty arbitration decision has ruled that India must release the waters of the western rivers for Pakistan’s unrestricted use. The Permanent Court of Arbitration delivered the ruling on August 8, later publishing it on its website on Monday.

According to the Foreign Office spokesperson, the court stated that India must allow the free flow of western rivers to Pakistan. Any exceptions for hydropower projects must follow the terms outlined in the treaty.

The spokesperson confirmed that the court’s decisions are final and binding on both parties. Pakistan has welcomed the ruling, which addresses the treaty’s general interpretation.

The decision also defines the design standards for India’s new run-of-the-river projects. It supports Pakistan’s stance on low-level outlets, gated spillways, turbine intake, and freeboard requirements.

Moreover, the ruling denies India the right to store excessive water. It holds special importance in light of India’s earlier announcement to suspend the treaty. The court recognized Pakistan’s weaker downstream position and upheld its historical stance.

The Foreign Office stressed that Pakistan remains fully committed to implementing the treaty. It also expects India to comply with the ruling.
