The Sindh High Court (SHC) has dismissed a petition filed by the parents of slain businessman Mir Raza Ali, who had sought the formation of a Joint Investigation Team (JIT) to probe his case.

The judgment was delivered by a division bench comprising Justice Adnan-ul-Karim Memon and Justice Muhammad Jaffer Raza.
The petitioners had approached the court seeking constitution of a JIT to investigate the disappearance and subsequent death of Mir Raza.
The court framed three questions for adjudication. These included whether constitutional jurisdiction can be invoked to direct JIT formation and whether the court can supervise an ongoing criminal investigation.
The bench ruled that this court has no power to direct formation of a JIT or supervise an ongoing investigation. The Mir Raza JIT petition dismissed judgment cited the Supreme Court’s precedent in the Sughran Bibi case. The court stated that it cannot assume the role of an investigator.

The court noted that the FIR does not include any provision under the Anti-Terrorism Act. Even if it did, forming a JIT would remain the prerogative of the government. The petitioners’ reliance on previous judgments was deemed misplaced by the bench.
The investigation officer assured the court of making best possible efforts to investigate the matter. The petitioners were advised to avail all legal remedies available to them. They may approach the court again if dissatisfied with the investigation upon its conclusion.
Single-Member Commission Already Formed
A Single-Member Commission of Inquiry was already formed under the Sindh Tribunals of Inquiry Ordinance.

The commission has also commenced its proceedings. The petitioners expressed confidence in this commission as it covers their requested relief.
The court extended its deepest condolences to the petitioners while upholding the law. The petition was disposed of with directions to allow the ongoing investigation to proceed.
