The U.S. Supreme Court has allowed Donald Trump’s controversial executive order on birthright citizenship to take effect in 28 U.S. states starting July 27, 2025.

The 6-3 ruling lifts a national block against the policy, which denies automatic citizenship to children born in the U.S. after February 19, 2025, if their parents are undocumented immigrants or hold temporary visas such as tourist, student, or work permits.

This decision affects states like Texas, Florida, Ohio, Georgia, and Indiana, where the court found no legal block. However, 22 other states, including California, New York, and Washington D.C., have active court orders preventing implementation of the rule for now.

Legal groups estimate that 1.5 million children per year could be affected, raising concerns over future access to education, healthcare, and employment.

While the ruling does not decide the constitutionality of the executive order, it marks a shift in how federal policies may be applied state-by-state. Legal experts warn this could create a regional divide in citizenship rights, which may undermine the 14th Amendment, traditionally guaranteeing birthright citizenship.

Critics argue the decision could open the door to confusing legal battles and deep social divisions, as citizenship rights vary across the country. New legal challenges have already been filed in Maryland and New Hampshire.

Meanwhile, the Trump administration hailed the decision as a victory for presidential power and the “rule of law.” Trump claimed liberal judges had previously blocked the will of the people.

The Supreme Court may ultimately decide whether the order violates the U.S. Constitution when its new session begins in October 2025. Until then, millions of families remain uncertain about the legal status of their U.S.-born children.
